By purchasing services from Hart & Summit, you agree to the following terms.
1. Our Services
Hart & Summit provides custom website design and development services for businesses.
We offer three website packages:
-
Essential: $599 CAD
-
Professional: $1,299 CAD
-
Signature: $2,499 CAD
Each package includes the services and deliverables described on our website or in the written project agreement at the time of purchase.
Additional features, services, or changes outside the agreed scope may require additional payment.
2. Payment Terms
All Hart & Summit website design packages require 100% payment upfront before work begins.
The full package price is payable at checkout. No installment payments or remaining balances are required for the selected package.
Website design and development will begin once payment has been successfully received and the client has submitted the necessary project information.
Any additional services outside the agreed package scope will be quoted separately and require client approval before payment is collected.
3. Project Onboarding
After purchasing a package, clients must provide accurate information through our project questionnaire.
This may include business details, branding materials, website content, design preferences, and other project requirements.
Work may be delayed if necessary information is missing.
4. Project Timelines
Estimated completion dates will be discussed with each client.
Timelines depend on project complexity, timely communication, content availability, and requested revisions.
Any material changes to the agreed schedule will be communicated to the client.
5. Revisions
Revisions are included according to the purchased package and written project scope.
Revisions generally cover reasonable changes to agreed design elements, content placement, and presentation.
New pages, additional functionality, major redesigns, or requests outside the agreed scope may require an additional quote.
6. Client Responsibilities
Clients agree to provide accurate information, necessary content, and materials they have permission to use.
Clients are responsible for reviewing website previews and providing feedback in a timely manner.
Clients must not supply content that infringes another person's intellectual property rights or violates applicable law.
7. Website Ownership and Delivery
Upon receipt of full payment, the client receives the agreed rights to the completed, client-specific website deliverables, as described in the project agreement.
Third-party software, fonts, stock assets, templates, hosting services, and other licensed components remain subject to their respective licensing terms.
Hart & Summit retains ownership of its pre-existing tools, methods, and materials unless otherwise agreed in writing.
Website launch, hosting, domain registration, ongoing maintenance, and third-party subscription costs are included only when expressly stated in the purchased package or project agreement.
8. Cancellations and Refunds
Cancellations and refunds are handled according to our published Return & Refund Policy and applicable law.
Clients may request cancellation by contacting hartandsummit@icloud.com.
9. Third-Party Services
Websites may use third-party platforms, including Lovable, domain providers, hosting services, and other integrations.
Third-party fees, availability, limitations, and terms may apply. Hart & Summit will identify relevant ongoing costs before final delivery.
10. Website Performance
Hart & Summit aims to deliver websites that meet the agreed project specifications and function properly at delivery.
We do not guarantee specific search engine rankings, website traffic, customer enquiries, sales, or business revenue.
11. Limitation of Liability
To the extent permitted by applicable law, Hart & Summit is not responsible for indirect or consequential losses arising from the use of delivered websites.
Nothing in these terms excludes rights, remedies, or liabilities that cannot legally be excluded.
12. Changes to These Terms
We may update these terms from time to time. Changes will not retroactively alter an existing client's agreed project terms without their consent.
13. Governing Law
These terms are governed by the applicable laws of Alberta and Canada, subject to any mandatory legal protections.
